The process of approving new premises boundaries has become stricter

On April 1, Federal Law No. 608-FZ will come into force, which will significantly change the procedure for registering redevelopment and reconstruction of premises in multi-apartment residential buildings. Without approval, it will not be possible to remove the built-in closet or move the doorway.

Now redevelopment will be considered a change in the boundaries of premises, a change in the internal layout of apartments, and the formation of new premises. According to the old rules, combining rooms or several apartments in an apartment building was classified as reconstruction.

According to the law, redevelopment will need to be approved when increasing or decreasing the area of ​​the apartment, allocating a new room – for example, a storage room, changing the boundaries of the room, or changing the internal layout. Without approval, it will not be possible to dismantle the built-in wardrobe or move the doorway.

The new law has clarified the deadlines for submitting documents on redevelopment, as well as when transferring residential premises to non-residential premises and vice versa. After completion of the work, the owner must receive an acceptance certificate from the invited commission and order a new technical plan of the premises from the cadastral engineer. If previously there were no deadlines for approving the act, now a specific period has been established – no more than 30 days.

After this, the approved act and technical plan are submitted for registration to Rosreestr, for which there are five working days. The redevelopment will be considered completed only after the department makes changes to the Unified State Register of Real Estate (USRN).

Let us add that the legislator retained a number of prohibitions during redevelopment. For example, it will still be impossible to combine the kitchen with the living room if there is a gas stove, move radiators to the balcony, make a water-heated floor and connect it to the general heating in an apartment building.
