Dismissal for Nirvana in the case of the baby from the album Nevermind

The iconic pouch of the scrapbook nevermind will therefore not cost any additional dollars to the surviving members of Nirvana. The group obtained Friday the rejection of a lawsuit brought by Spencer Elden, the former model of the naked baby photographed in 1991, which claimed at least 450,000 dollars in compensation. The American justice declared that this one, now 31 years old, had waited too long before filing a complaint and being a victim.

“Plaintiff has been unable to allege that he had knowledge of a violation that occurred while he was a minor, or of an injury, the basis of the claim, within ten years of the filing of the claim. this action”said the American judge in charge of the case. Spencer Elden had filed a complaint in August 2021 against the two surviving members of the group and in particular a photographer for exploitation “child pornography” of his image and because of his emotional distress. In all, 17 people have been charged by three different complaints filed by Spencer Elden. “Its pretty hard.
