The White House has until September 1 to revise the lists of mandatory business requirements, which should come into force before the end of 2024. Additional expertise was required in connection with attempts to reduce administrative pressure on entrepreneurs in the face of sanctions due to the military operation of the Russian Federation in Ukraine – an instruction to this effect was given by the president following an appeal by business ombudsman Boris Titov. However, after the reform of control and supervisory activities, the analysis of the effectiveness of mandatory requirements and their impact on business activity is already being conducted online – the instruction de facto expands the horizon of this work for a three-year period.
As it became known to Kommersant, federal agencies will have to re-analyze the impact of mandatory requirements on business by September 1, assessing the socio-economic consequences of their introduction and the possible costs of entrepreneurs. In case of negative assessments, the introduction of such requirements is proposed to be canceled or postponed.
According to Kommersant, the instructions for a new revision were given to the departments by Deputy Prime Minister and Head of the Government Staff Dmitry Grigorenko, who oversees the reform of control and supervisory activities – they must form lists of requirements that were to come into effect from September 1, 2022 to December 31, 2024 . All of them have already been considered by specialized working groups at the site of the Analytical Center under the Government (deadline – until August 17), and the final proposals on the advisability of maintaining mandatory requirements should be made by the Ministry of Economy. The representative of the department confirmed the existence of this order. “Until August 24, we will send generalized proposals to the government based on the results of the analysis,” the press service of the Ministry of Economy said.
Formally, the reason for the new revision of the requirements was the order of the president after the appeal of the Commissioner for the Protection of the Rights of Entrepreneurs Boris Titov. “Under the conditions of business adaptation to new economic conditions, characterized primarily by temporary restriction of access to the resource and component base, it is undesirable to create additional costs for business,” Maxim Oreshkin, assistant to the president for economic issues, comments on the business ombudsman’s proposal in a letter to Vladimir Putin (available at “b”). In turn, Boris Titov explains that he proposed establishing a moratorium on new mandatory requirements, which entail new business costs, for 2023–2024. “By default, it is expected that if the effect on business from them (mandatory requirements.— “b”) is, to put it mildly, “not zero”, then such requirements should be postponed or canceled,” he adds.
It should be noted, however, that as a result, the new mandatory requirements will fall under double control – the assessment of their effectiveness and impact on business is already being conducted by the government online. To do this, as part of the reform of control and supervisory activities (KND), the White House set up an automated system for collecting data on KND and formed a working group to manage such data to fine-tune regulation (see Kommersant dated March 2 and 5, 2021). Dmitry Grigorenko’s office confirmed to Kommersant that the optimization and updating of mandatory requirements for business is an ongoing process that was not limited to the “regulatory guillotine”. “Working groups with business participation are evaluating the feasibility and economic effect of introducing new requirements online. In accordance with the instructions of the President, this work is carried out by assessing the prospects for the next three years, ”the White House explains.
They remind that the introduction of mandatory requirements is possible twice a year – on March 1 and September 1, which allows businesses to better understand the legal field and predict their actions. Meanwhile, in 2022, due to the introduction of sanctions, the introduction of mandatory requirements of a massive nature was already postponed, that is, on September 1, separate specialized requirements (about 230) that professional market participants need will be introduced. This array will be further analyzed by the White House in terms of creating new costs for companies.
