Russian banks were not included in the list of those who are granted access to the unified register of persons liable for military service and the additional register of subpoenas. Thus, they are unable to comply with the recently passed law on electronic subpoenas, which requires banks to refuse loans to draft evaders. This is stated in the letters of the National Financial Market Council (NSFR) to the Ministry of Defense and the Bank of Russia, which I read RBC. The authenticity of the documents was confirmed by the chairman of the NSFR Andrey Yemelin.

“The fact that banks will be involved in the implementation of the new norms was a discovery for everyone in the market. It is very strange that, when setting the requirement for financial institutions, neither they nor the Bank of Russia were involved in the discussion,” said Mr. Emelin. According to him, in the near future the NSFR will send an appeal on granting access to the register of persons liable for military service and to the Ministry of Digital Development, which is responsible for its creation.

According to the text of the letter, the NSFR asks to provide market participants with access to the dates of the agenda, its delivery and the start of restrictive measures. Also, banks need information about the appeal by citizens of decisions taken against them on the application of interim measures. The NSFR proposes to give credit institutions access to the unified register for 60 seconds and without obtaining the prior consent of the citizen.

In addition, the NSFR asks for clarification on how credit institutions should act if, at the time of applying for a loan, a citizen has not yet received a summons, and on the day the contract is concluded, the client is already considered a evader. According to Mr. Emelin himself, most likely, in this case, creditors will have to refuse the borrower at the final stage.

The Chairman of the National Financial Markets Service notes that in addition to accessing creditor registers, it is necessary to obtain enough information from there to compare data on potential borrowers with the list of recipients of subpoenas. “If the full name and address of residence are enough for the Ministry of Defense, then we will have a huge number of such matches, so the list of information should be sufficient for unambiguous identification,” he specified. Andrey Emelin stressed the fundamental importance of receiving “batch” requests for information on the list of clients in order to automatically check all loan applications at once.

April 14 President Vladimir Putin signed the law on the introduction in Russia of a unified register of persons liable for military service, equating electronic summonses to paper ones. It is assumed that from the date of receipt of the summons (both in electronic and paper form), in addition to the ban on obtaining bank loans, the recipient’s ability to leave Russia is limited. According to the head of the Ministry of Digital Development Maksut Shadayev, the unified register of military registration will work for the autumn call.
