Amendments were introduced to the State Duma on detention in the zone of martial law

A group of senators and deputies submitted amendments to the State Duma on detention for up to 30 days in a martial law zone for violating the prohibitions established by decree of the President of the Russian Federation. Changes are made to the federal constitutional law “On Martial Law” and to the draft FKZ “On Amendments to Certain Federal Constitutional Laws.”

“In particular, on the basis of decrees of the President of the Russian Federation on the territory where martial law has been introduced, such measures as administrative detention for a period of up to 30 days are applied in case of violation of the prohibitions and restrictions established by decrees of the President of the Russian Federation in the relevant territory, as well as forced and controlled movement of citizens from the relevant territory to territories where martial law has not been introduced,” Klishas specified.

Also, during martial law in the region, referendums and elections to state authorities and local self-government bodies cannot be held. The exception is the decision on this after consultations with the Ministry of Defense of the Russian Federation and the FSB of the Russian Federation. In this case, elections and referendums may be held both in the entire region in which martial law is in force, and in a part of such territory.

The introduction of martial law implies that the protection of public order can be strengthened in the regions, the introduction of a special regime for entering and leaving the territory of the region, the prohibition or restriction of rallies and other mass events, as well as the prohibition of strikes, the introduction of a curfew, etc.

The Russian special operation in Ukraine began on February 24, 2022. During the hostilities, Russian troops took control of the LPR, as well as most of the DPR, Kherson and Zaporozhye regions. Subsequently, these territories became part of the Russian Federation.
