The company Davide Campari-Milano NV appealed to the Arbitration Court of the Rostov Region with a demand to prohibit the local distributor Master-Trade from importing and selling drinks under its Aperol brand. About it testify data in the court file. Kommersant drew attention to the lawsuit.

A hearing in the case is scheduled for October 30. Previously, the court denied Campari interim measures in the form of a ban on the release of goods. The company noted that it did not consent to the supply and that the Aperol brand is not included in the list of goods allowed for parallel imports.

The Master-Trade website says that the distributor supplies Trozo and Lamazi wines, Campbell Meyer & Company whiskey, Shaman’s vodka, etc. Newspaper writes, that, according to the Federal Accreditation Agency, the company has a declaration for the supply of Aperol. Master-Trade also previously received a declaration for Martini Asti. Russian Bacardi refused to comment on possible claims against third-party distributors. Campari and Master-Trade also did not respond to the publication’s request.

As Yulia Shlenskaya, president of the customs and logistics broker KVT Service, explained, in a situation where a brand is included in the Customs Register of Intellectual Property Objects (TROIS), but is not allowed for parallel import, customs requests permission from the copyright holder to release the goods. If he is silent, then customs can release the goods if there are no signs of counterfeit. Shlenskaya admitted that Campari might not have responded to Russian customs in time.

The Federal Customs Service stated that the lack of consent of the copyright holder is not grounds for refusing release.

Against the backdrop of the start of Russia’s special operation in Ukraine, Campari announced the suspension of investments and reduction of business in the Russian Federation. Kommersant, citing data from market participants, writes that from January to July 2023, Campari Rus imported 3.12 million liters of alcohol into Russia, compared to 3.58 million liters a year earlier. The company’s revenue at the end of 2022 reached 7.5 billion rubles. (+20.9% compared to 2021), and net profit – 507.6 million rubles.
