The Russian Ministry of Industry and Trade proposed using a special procedure for approving transactions with investors from unfriendly jurisdictions when selling exclusive rights to the result of intellectual activity. Changes are proposed to be made to Decree N81 of March 1, 2022 “On additional temporary economic measures to ensure financial stability” of the Russian Federation. A special procedure is expected to be established for transactions “on the alienation or pledge of exclusive rights to the result of intellectual activity or to a means of individualization” (name of a non-profit organization, trademark).
The Ministry of Industry and Trade believes that the proposed measure will minimize the risk of “unfair law enforcement practices” and will provide additional revenue to the federal budget.
A decree on measures to ensure financial stability was signed by Russian President Vladimir Putin on March 1, 2022. It assumes that transactions with foreign persons from unfriendly states require permission from the government commission for control of foreign investment.
