The Federation Council proposed not to protect the rights of authors of foreign films when shown in Russia

The head of the Federation Council committee on economic policy, Andrey Kutepov, and his first deputy, Alexei Sinitsyn, have developed a bill proposing not to protect the rights of authors of foreign films from “unfriendly” countries until 2025. The authors of the initiative explained that the solution of industry issues “within the framework of parallel imports is impossible, since the film is not a commodity.” The document is scheduled to be sent to Prime Minister Mikhail Mishustin today, May 29.
The draft law proposes not to apply the provisions of the Civil Code of the Russian Federation, which define the rules for using the result of intellectual activity as part of a complex object (movie), as well as protecting the rights of the author to the results of intellectual activity and liability for violation of exclusive rights (for example, unlawful showing of a film in a cinema). Mr Kutepov told TASS that the proposed measures “will allow cinemas to break even.” “At the same time, the necessary contributions to the Cinema Fund and the Russian Authors’ Society (from cinemas, TV channels.— “b”) will be preserved,” he added.
The Russian film industry has been struggling with profitability since 2020, when movie theater occupancy was limited amid the coronavirus pandemic. Against the backdrop of the Russian military operation in Ukraine, Western companies began to refuse to provide films for Russian distribution. Because of this, the practice has spread in Russia “pre-session service” – “free” screening of Hollywood films before domestic films indicated on the tickets.
