The Deputy Head of the Institute of Industrial Property reported on the growth of requests for registration of Russian trademarks

Roman Zakharov, Deputy Director of the Federal Institute of Industrial Property (FIPS), announced an increase in the share of applications for trademark registration from Russian entities. Within the framework of the St. Petersburg International Legal Forum, at a session dedicated to the protection of intellectual property rights, Mr. Zakharov noted that the area of trademark registration is one of the most “intensively growing areas”.
In 2022, 90 thousand Russian applications for the registration of marks were filed (80.4% of the total), for comparison, in 2021 their number was less than 79 thousand (73.8%). According to Mr. Zakharov, this increase in the number of domestic applications occurred against the backdrop of a decrease in foreign applications (to 22,000 in 2022 against 28,000 in 2021). The most demanded areas for entrepreneurs were clothing, footwear and software. The number of active trademarks also showed growth, amounting to a record 81.14 thousand in 2022, of which 60 thousand belong to Russian manufacturers (47 thousand in 2021). The FIPS spokesman said that this was due to a 9% decrease in the number of refusals in the registration of marks due to “reduction of the time for consideration of applications” and the softening of “excessively harsh approaches.”
Olga Ruzakova, Deputy Chief of Staff of the Russian State Duma Committee on State Construction and Legislation, added at the same session that over the past year a number of changes have been made to the relevant legislation that expand the “free use of objects of intellectual property rights”.
From June 29, 2022, individuals can also register a trademark, whereas previously only legal entities and individual entrepreneurs had this right. Ms. Ruzakova noted that in the near future it is planned to submit to the State Duma a bill on the protection of authors of both original and derivative works in case of misuse of the latter, which will also include measures to determine compensation for violation of such exclusive rights.
