The court fined Wikimedia 800 thousand rubles for refusing to remove the article about the banned song “Psyche”

The World Court of the Tagansky District of Moscow fined the Wikimedia Foundation (which owns Wikipedia) 800,000 rubles. The court called the refusal to remove the material about the song of the Psyche group banned in Russia as the reason, TASS reports.
It follows from the case file that the protocol against the Wikimedia Foundation was drawn up by Roskomnadzor under Part 2 of Art. 13.41 Administrative Code of the Russian Federation. In 2010, the Dorogomilovsky Court of Moscow recognized the composition of the Psyche group “Kill the Ment” as extremist material. Based on this decision, the FSB demanded that the fund remove the article about the song from Wikipedia. Wikipedia, as stated in the case file cited by TASS, did not remove the page on the song’s ban.
During the court session, a representative of the Wikimedia Foundation demanded that the case be dropped and that the company not be held liable. She insisted that the legal representative of the Wikimedia Foundation had not been identified and notified of the wrongdoing. “According to the law, the case must be considered at the location of the involved person. This is Florida. Our Code of Administrative Offenses does not apply there,” she emphasized.
In addition, a representative of the Wikimedia Foundation noted that, in accordance with established practice, the Prosecutor General’s Office, and not the FSB, makes the request to remove materials. However, the court rejected these arguments.
At the end of February the court fined Wikimedia Foundation for 2 million rubles. for refusing to remove materials about military units of the Russian armed forces. In April last year, the Wikimedia Foundation was fined 5 million rubles. for publishing an article about the events in Bucha, the destruction of the hospital and theater in Mariupol. Roskomnadzor obliged search engines warn users about violations of the law by Wikipedia. The site was threatened with blocking.
