The Podolsky City Court in the Moscow Region declared illegal the requirement of the Wildberries marketplace for buyers to pay for the return of goods of inadequate quality. This was announced by the deputy head of the department of Rospotrebnadzor for the Moscow region Nikolai Drozd, his words are quoted by RBC.

According to the publication, Rospotrebnadzor filed a lawsuit against Wildberries in early March. According to the court file, the claim was satisfied on April 13.

According to Roskomnadzor, demanding funds from buyers for the return of defective goods, Wildberries violates the norms of the current legislation. The department reported that it issued a warning to the marketplace about the inadmissibility of violating mandatory requirements. The lawsuit was filed to protect the protection of the rights of an indefinite number of consumers. “When the court decision comes into force, each consumer will have the opportunity to apply to the seller for compensation for property damage associated with the paid return of defective goods purchased under a sales contract with Wildberry LLC,” Rospotrebnadzor representatives said.

In turn, Wildberries said they would appeal the court’s decision. “The court did not fully understand the circumstances of the case: representatives of the company were not present because they were not properly notified and were unable to present their arguments,” said the representative of the marketplace. Wildberries added that the cost of a defective item and its delivery to the warehouse is compensated by the seller, not the buyer.

On March 9, Wildberries announced the introduction of new rules for entrepreneurs. They were charged the full cost of the order if, when it was returned to the warehouse, a defect or substitution was found. In April, against the backdrop of a conflict with the owners of pickup points due to innovations, the marketplace softened fines.
