Tax officials were put out of turn // SC established the priority of budget debts

The Supreme Court of the Russian Federation (SC) considered a dispute about whether a third party can repay an off-register debt to tax authorities for a bankrupt before the creditors included in the register receive the money. According to the general rule, extra-registry claims should be satisfied last, therefore, the arbitration courts considered such repayment unlawful. But the Supreme Court allowed the tax requirements to be fulfilled ahead of schedule. According to lawyers, the purpose of repayment may be the desire of other participants in the process to “remove an overly active creditor.”
