“Sportloto” sued the trademark from the TV channel “Dozhd”* – Kommersant

“Sportloto” achieved early termination of the protection of the “Here and Now” trademark, follows from the decision of the court on intellectual rights. Previously, under this name, the Dozhd TV channel (declared a foreign agent, the legal entity of the Dozhd TV channel in Latvia and the Netherlands is recognized as undesirable organizations) produced a news program. The lawsuit itself was filed on November 3 last year (see “Kommersant” dated November 8, 2023). Sportloto reported that it wanted to hold an instant lottery under the same name.

In November 2023, the distributor of state lotteries, TK Center, filed an application to register the trademark “Instant Lotteries. Here and now,” but was refused by Rospatent “due to the presence of a trademark with earlier priority.” After the refusal of the federal service, TK Center, through Sportloto, filed a complaint against the inspection decision in the Chamber for Patent Disputes of Rospatent and went to the intellectual property court to early terminate the channel’s trademark. According to Sportloto, the trademark “Here and Now” is no longer used and does not require legal protection.

By court decision, Dozhd (declared a foreign agent) lost the rights to the trademark for the 38th class of services (telecommunications services, broadcasting and data transmission services), but retained the 41st (all services related to entertainment and entertainment, including including the production of television and video films).

Dozhd (declared a foreign agent) registered the trademark “Here and Now” on July 9, 2014 and has exclusive rights to it until 2031.
