"Ruskhimalliance" filed a claim against the German Linde and its subsidiaries for 105 billion rubles

Ruskhimalliance (RHA; partner of Gazprom and Rusgazdobycha on projects in Ust-Luga) filed a new claim against the engineering company Linde and its Russian subsidiaries for 105.5 billion rubles. As follows from card indexes Arbitration Court of St. Petersburg and Leningrad Region, the claim was filed on March 20.

The claim is directed against Linde GmbH of Germany and its parent company Linde PLC, registered in Ireland. The companies named in the lawsuit are Cryostar Rus, Linde Gas Novotroitsk, Gazprom Linde Engineering, Linde Uraltekhgaz, Linde Engineering Rus, Rencons Heavy Industries and Linde Gas Lipetsk.

February 22 Arbitration Court of St. Petersburg satisfied RHA’s claim to invalidate Linde’s compliance with EU sanctions. After the introduction of sanctions in 2022, Linde suspended work on the contract for the implementation of the gas chemical complex in Ust-Luga. RHA sought damages for failure to comply with all terms of the contract for the design, procurement and construction of the project.

Legal proceedings began in December 2022: the court seized Linde’s Russian assets worth about 35 billion rubles. Linde is trying to challenge the decision in international arbitration and suspend the recovery of $1.2 billion in favor of RHA. In February, Russian Alliance filed a lawsuit demanding that Linde be prohibited from continuing legal proceedings abroad.
