Rushimalliance plans to file a lawsuit against Linde in the Hong Kong Arbitration Center

One of the operators of the construction of a gas processing complex in Ust-Luga, Rushimalliance (a parity joint venture between Gazprom and Rusgazdobycha), plans to initiate arbitration proceedings in Hong Kong in order to recover from Linde an advance and losses incurred as a result of the refusal of the German company from obligations under construction of a gas processing plant.

According to the agency, on December 20 last year, the court ordered Rushimalliance to proceed with the pre-trial settlement of the dispute with Linde within 15 working days after the application for interim measures was satisfied. So, the company must send a notice of referral of the dispute for consideration by senior management; then after 45 days and 5 working days, a Notice of Arbitration must be sent to the Hong Kong International Arbitration Center.
In addition, the court ruled to seize the property of the defendants in the course of the trial — the Linde branch in Samara, shares in the authorized capitals of JSC Linde Gas Rus, JSC Linde Uraltekhgaz, LLC Linde Gas Novotroitsk, LLC Linde Gas Lipetsk , OOO “Gazprom Linde Engineering, Linde Engineering Rus LLC, Cryostar Rus LLC, Linde Azot Togliatti LLC; Praxea Rus LLC; Praxair Volgograd LLC; Praxair Samara LLC; Praxair Azot Togliatti LLC.
In June, the German company Linde GmbH withdrew from a joint venture with Rushimalliance (50% each from Gazprom and Artem Obolensky’s Rusgazdobycha) for the production of spiral cryogenic heat exchangers for the gas processing industry and gas liquefaction.
“Rushimalliance” creates in Ust-Luga (Leningrad region) a complex for the processing of ethane-containing gas (CEG). As part of the project, one of the world’s largest gas processing plants (GPPs) with a capacity of 45 billion cubic meters is being built. m per year, as well as a plant for the production of liquefied natural gas (LNG) with a capacity of 13 million tons (Baltic LNG). The launch of production lines at these plants is planned for 2024–2025.
The German company said that the decision was caused by EU sanctions, but Rushimalliance expressed confidence that the restrictions did not affect work under the contract, and since Linde refused to cooperate anyway, the contract was terminated.
