What is an emergency fund, under what programs is the resettlement of uninhabitable houses and where to contact the owners to get new housing – in the material “Kommersant”.

On January 28, 2006, the government of the Russian Federation determined the reasons for recognizing the house as emergency and subject to demolition, as well as the procedure for this process.

According to Decree 47a residential high-rise building can be recognized as emergency if:

not recoverable after an emergency – earthquake, flood, explosion or fire;

there was a deformation of its load-bearing structures, foundation or walls, after which there was a threat of collapse;

the stability of the building is broken due to the presence of a roll;

is located in a dangerous zone, which can lead to destruction as a result of man-made accidents, or there is a risk of a natural disaster – for example, there is regular flooding of the territory, mudflows or snow avalanches;

·located in an area where indicators of sanitary and epidemiological safety – noise, background radiation, etc. – do not meet hygienic standards.

According to paragraph 4 of Art. 15 of the Housing Code of the Russian Federation, all residential premises in a high-rise building, which is recognized as emergency, are unsuitable for habitation. Both its owner or tenant, as well as control and supervision authorities, can submit documents to recognize the premises as such.

How to recognize a house as emergency

In each municipality, a special commission has been created, consisting of representatives of various departments, which makes a decision on recognizing housing as emergency. Usually this issue is dealt with by a group of experts from Rospotrebnadzor, state housing and fire inspections.

To start the process of recognizing a high-rise building as emergency, you need to apply to this commission with a request for resettlement and a description of the state of the object, attach documents for the property or a social lease agreement, a technical passport indicating the percentage of depreciation of the building and back it up with an examination of design and survey work. If there are not enough confirmations, an additional check may be scheduled.

“The decision on inclusion in the program is made at the regional level. The nuances of preparing documents may vary in the subjects of the Russian Federation. Sometimes it is possible to resolve issues of improvement through a major overhaul of housing – this is a faster solution to problems. If in this way it is impossible to put the housing in order, then, having received the appropriate conclusion, it is possible to initiate inclusion in the resettlement program. The speed of resolving the issue depends on the strategic plans and allocated funds – federal and regional. If there is a danger to the life and health of residents, then as a temporary solution, relocation to a maneuverable fund is possible. At the same time, such tenants automatically become participants in the resettlement program. Ideally, for example, as part of a renovation program, when leaving the emergency fund, they immediately move into a new one. How is relocation from emergency housing

Since 2019, Russians have been relocated from uninhabitable houses as part of the national project “Housing and Urban Environment”. The current program runs until 2025.

“The program is financed from several sources: the federal budget, as well as consolidated regional budgets. Financial support from the federal budget is provided to the constituent entities of the Russian Federation based on the total area of ​​the housing stock located on their territories, recognized as emergency before January 1, 2017. In total, within the framework of the federal project, by the end of 2024, it is necessary to relocate 509.48 thousand people from uninhabitable housing with an area of ​​9.03 million square meters. m,” said Konstantin Tsitsin, general director of the public law company Territorial Development Fund, chairman of the board of the Housing and Public Utilities Reform Assistance Fund.

By opinion Deputy Prime Minister Marat Khusnullin, the implementation of the national project will be completed ahead of schedule – before the end of 2023. In the first three months of 2022, more than 70 thousand citizens have already received new housing.

The deadlines for the implementation of the resettlement program can be found on the website Fund for Assistance to Housing and Public Utilities Reform or by requesting information from the administration of the municipality. In priority order, living space is settled where there is a clear threat of collapse.

Where do they move from an emergency house

Owners of dilapidated property may qualify for two reimbursement options. One of them – financial compensation for housing. As a rule, the valuation of the premises is carried out by an independent expert, which is calculated based on the market value. Often, the amount offered is not enough to buy a new apartment, because the condition of the apartment building itself is also taken into account: the worse it is, the lower the cost. There is also an alternative option – to settle in the order of the queue in apartment offered under the program. In any case, separate agreements are drawn up with the owners. The owners of the emergency fund are entitled to housing equivalent to the past, in particular, in terms of area and number of rooms. In addition, apartments in new high-rise buildings must be equipped with bathrooms, communications, a stove and have a fine finish, and the house itself must be located within the same area or, in agreement with the owner, in another district or municipality. If one of the rules is not met, the owner has the right to file a claim with the court.

According to Konstantin Tsitsin, preparations are underway for the formation of a new program for resettlement from emergency housing, recognized as such in the period from January 1, 2017 to January 1, 2022: “Nine regions that have met the targets to date will be the first to start implementation. At the same time, the Housing and Communal Services Fund keeps records of the entire emergency housing stock, including those recognized as emergency and after January 1, 2022. The resettlement of these houses under the new programs will be possible using the mechanisms of integrated development of territories. This will allow the constituent entities of the Russian Federation to attract funds from investors and resettle such houses, including through extrabudgetary sources of funding. Also, the regions can resettle citizens within the framework of their own programs, both regional and municipal, without the participation of the financial support of the fund.”
