The Arbitration Court of the city of Moscow satisfied the claim of the Law and Finance company, which Raiffeisenbank refused to open a bank account. According to file cabinet arbitration cases, the court ruled that the bank did not have the right to refuse to open an account if it did not substantiate its decision, and ordered Raiffeisenbank to conclude an agreement on settlement and cash services with the Law and Finance company. In addition, the credit institution must pay the costs of the company “Law and Finance” for the payment of the state fee in the amount of 6 thousand rubles.
It follows from the case file that on November 3, 2022, the Law and Finance company filed an online application with Raiffeisenbank to draw up an agreement for “conducting business activities” and confirmed its readiness to pay for the bank’s services. However, the company’s account was refused. She turned to Raiffeisenbank with a request to clarify the reasons for the refusal, but the bank did not respond to the letter.
Evgeny Mitrofanov, General Director of Law and Finance, told Vedomostithat Raiffeisenbank referred to internal documentation in an e-mail message about the refusal to open an account. These documents give the credit institution the right to refuse to open an account if the client did not provide the necessary data, or if the bank considered the information to be contradictory to the information at its disposal.
The court decision emphasizes that banks do not have the right to refuse to open an account for a client, since this obligation is provided for by the license issued to him. At the same time, the civil code allows the bank to refuse to open an account, but in this case, the reasons must be motivated and justified, the judge said.
Raiffeisenbank may appeal the court decision within 30 days from the date of its adoption. At the same time, the bank will have to prove that the Law and Finance company opened an account in order to violate the law, Dmitry Kletochkin, partner at the law firm Rustam Kurmaev and Partners, told Vedomosti.
Raiffeisenbank turned out to be one of two subsidiaries of foreign banks from the list of systemically important, which are not sanctioned. The restrictions also did not affect Unicredit Bank. Since March 3, Raiffeisenbank has suspended the opening of accounts for new clients – legal entities and individual entrepreneurs – due to a record number of new applications. This applies to both ruble and foreign currency accounts. At the beginning of 2023, Raiffeisenbank served 3.2 million clients.
