Poland may change constitution to confiscate Gazprom’s assets

Poland intends to withdraw Gazprom’s stake in Europol Gaz, but does not have legal instruments for confiscation. In this regard, the Polish authorities are preparing amendments to the constitution, said the spokesman for the Polish government, Piotr Muller. Earlier, Warsaw introduced temporary compulsory management of Gazprom’s assets.
“I want to clarify one thing, since we said that for such a decision (confiscation.— “b”) a change in the constitution is needed, it is important to clarify that this is a temporary administration, and not nationalization. In fact, without amendments to the constitution, the arrest or confiscation of Russian property is impossible,” Mr. Muller told reporters. His words are quoted by the publication 300.
According to the press secretary, the draft amendments to the constitution have already been submitted to the Seimas, and they are ready to put it to the vote, but only if the initiative is appreciated by the opposition.
“This proposal will be difficult to put to a vote if it does not receive a sufficient majority in the Seimas. In the worst case, the Polish parliament will reject it. The draft will be submitted for revision only if the opposition is ready to support it,” Piotr Muller said.
Decision on withdrawal of PJSC Gazprom’s share in Europol Gaz accepted Minister of Economic Development and Technology of Poland, Waldemar Buda, at the request of the Internal Security Agency. Europol Gaz is the operator of the Polish section of the Yamal-Europe gas pipeline. It passes through the territory of four countries – Russia, Belarus, Poland and Germany. Gazprom and the Polish PGNiG each own 48% of the enterprise, the Polish PKN Orlen – 4%.
