The State Duma is discussing the issue of paying royalties to foreign agents for copyright and related rights to a special ruble account, where they will actually be frozen. This is reported by RTVI with reference to the first deputy chairman of the State Duma Committee on Culture, Elena Drapeko.
“There is an option that we have used for Western companies. Payments to unfriendly copyright holders are already made in rubles to a special account. With regard to foreign agents, we are discussing this version. This is just one of the options,” the TV channel quotes Ms. Drapeko as saying.
We are talking about the decree of Russian President Vladimir Putin dated May 27, 2022. According to it, Russian individuals and legal entities, authorities and organizations established by them received the right to pay in rubles under existing licensing contracts with foreign copyright holders. Payments were allowed to be made to special “O” accounts in authorized banks. But in order to write off funds from such a special account, the copyright holder needs to obtain permission from the government commission for control of foreign investments, Ms. Drapeko indicated.
This is not the first step by the Russian authorities to limit the income of foreign agents. On February 28, the State Duma adopted a law completely banning advertising on all resources of foreign agents on any platforms, as well as their promotion. The advertiser and distributor are responsible for violation. State Duma Speaker Vyacheslav Volodin on March 5 in his Telegram channel reported that deputies are receiving proposals to prohibit the payment of royalties for copyright and related rights to foreign agents (musicians, artists, writers) who are engaged in discrediting the armed forces of the Russian Federation. At the same time, media market participants feared that the new measure jeopardizes the business of monetizing intellectual rights as a whole (see “Kommersant” dated March 5). In addition, according to all international copyright conventions, from which Russia has not yet withdrawn, it is impossible to use a work without paying remuneration if the author does not allow it, experts argued.
