OpenAl sent statement to the District Court of New York with a request to dismiss a lawsuit by The New York Times (NYT), which accused the developer of the chatbot ChatGPT, as well as Microsoft, of copyright infringement and illegal use of journalistic materials. OpenAl claims that the newspaper paid certain individuals to hack the chatbot.
The statement alleges that the New York Times, with the help of a third party, manipulated ChatGPT, “flagrantly violating” the rules for using a chatbot to reproduce its materials. OpenAl believes that the newspaper took advantage of “bugs and loopholes” in the program and uploaded fragments of its texts.
NYT filed lawsuit against Microsoft and OpenAI in December 2023. The newspaper said the ChatGPT and Bing Chat language models were created by “copying and using millions of news stories, investigations, opinion pieces, reviews and other materials from the Times.” At the same time, the journalists did not give permission to use their materials, the lawsuit noted.
In September, 17 American writers and their representative Authors Guild filed class action lawsuit against OpenAI. Among the plaintiffs are John Grisham, George R.R. Martin, Jodi Picoult and others. They also accused the company of copyright infringement, asking the court to admit its guilt and determine the amount of damage caused to them.
