Ministry of Economy proposes to reduce turnover fines for data breaches

The Ministry of Economy, in its response to the bill on turnover fines for personal data leaks, proposed to reduce them. The ministry proposed a fine of up to 500 million rubles. called “unreasonably high”.
According to the document, which was sent to the government, if the leak concerns from 1,000 to 10,000 citizens, the fine for legal entities will be from 3 million to 5 million rubles; for data leakage from 10 thousand to 100 thousand citizens – from 5 million to 10 million rubles; more than 100 thousand – from 10 million to 15 million rubles. For a repeated violation that affects more than 1,000 citizens, a fine of 0.1 to 3% of revenue for the calendar year preceding the violation, or for part of the current year, is proposed, but not less than 15 million and not more than 500 million rubles.
The Ministry of Economy considered that an increase in fines by 100 times or more requires additional justification, reports RBC.
Earlier, the Association of Internet Trade Companies (AKIT), among whose members are Wildberries, Ozon, Yandex.Market, Lamoda, Citylink, proposed its changes to the bill. According to her proposal, turnover penalties should be applied only to those operators that have repeatedly leaked data of more than 1 million users, and the bill’s entry into force should be postponed to September 2024.
It is now assumed that the amendments will come into force 30 days after the official publication. “The opinion of business, including AKIT, is taken into account in terms of the competence of the ministry,” commented a representative of the Ministry of Economy.
According to a report by Group-IB (now under the FAC.С.T. brand), the volume of leaks of personal data of Russians in 2022 increased 40 times compared to 2021. During the year, personal information of about 100 million citizens of the Russian Federation got into open access.
