One of the incriminated posters, in Toulouse, August 16, 2022.

The Haute-Garonne prefecture and the regional health agency (ARS) Occitanie initiated legal and other administrative proceedings on Monday August 22 to have 4×3 posters signed by antivax movements removed from city walls. . On a dozen of these advertisements, which appeared at the beginning of July, one could read, above a giant syringe: “One in 100 serious side effects, what if it was your child? ». “Their health is worth more than experimental vaccines. Vaccines against Covid cause a cardiovascular accident every 100 injections. » A campaign signed by the “independent scientific council” and by the RéinfoCovid and RéinfoLiberté sites, collectives of health professionals refractory to compulsory vaccination. Among them, the infectiologist Christian Perronne or the anesthesiologist-resuscitator Louis Fouché, very influential in antivax circles.

Positioned in very visible places and on private land, this campaign first caused the municipality to react, declaring itself “shocked by this misinformation”but does not have the legal means to prohibit it, because it does not present a “disturbance to public order”. On August 19, Sonia Backès, the Secretary of State responsible for citizenship, asked “the prefect to use the appropriate legal remedies to put an end to it”. “A prohibition order will be taken, and a report sent to the public prosecutor. Stop misinformation! », she said on Twitter.

“Threat to public health”

So it’s done. The report to the prosecutor at the Toulouse judicial court denounces a campaign “capable of constituting an offense punishable by criminal prosecution on the basis of article 27 of the law of July 29, 1881 on the freedom of the press”. This imposes a fine of 45,000 euros on the publication and dissemination of false news, when, made in bad faith, “it will have disturbed the public peace or will have been likely to disturb it”. At the same time, an adversarial administrative procedure gives the display and the advertisers three days to withdraw the advertisements, “prior to issuing a prefectural order banning the poster campaign”. For the prefecture and the ARS, it is a question of “threat to public order and public health”.

If the members of RéinfoCovid have still not reacted, or even officially claimed this campaign, the Toulouse company targeted by these procedures, Luchetta Peinture Sérigraphie, returns the ball to another company. The billboards in question actually belong to Publimat, a company based in Nancy. The management of Luchetta claims that these panels “were sold in 2017, even though our name is still there”. Contacted, the Lorraine company refused to answer the questions of the World. In 2017, Publimat found itself at the center of a small controversy after the installation of posters praising a brothel in Germany. The dozen 4 × 3 had been removed from public space after a week.
