The pace of installation of technical means for collecting and transmitting information to intelligence services by telecom operators remains extremely low, said FSB spokesman Alexander Samoilov. Operators are required to pre-install these tools as part of the Yarovaya laws package aimed at countering extremist and terrorist activities.

“Unfortunately, today the pace of implementation of the Yarovaya Law in terms of installing technical means of operational investigative measures on their networks remains extremely low,” said Mr. Samoilov during a speech at the Spectrum 2023 forum (quote from Interfax). .

The FSB representative named the main reasons “the presence on the market of a significant number of unscrupulous operators who provide services in violation of the law” and a moratorium on inspections of their activities. According to Alexander Samoilov, telecom operators use different methods of evading responsibility. For example, they formally enter into agreements “for interaction with the authorized body without further implementation of the necessary equipment,” renounce existing licenses and obtain new ones, and change legal entities.

The FSB clarified that for an operator’s refusal to implement SORM (system of operational investigative measures), courts often impose a fine of 3 thousand to 100 thousand rubles. But from January 2024, for failure to comply with these requirements, turnover fines will be introduced based on the amount of the company’s revenue for the provision of communication services, but not less than 1 million rubles. The FSB believes that this amount is commensurate with the operator’s cost of purchasing the appropriate equipment or leasing it.

Fines for violations have already been increased before – from December 2020 they were increased from 30-40 thousand rubles. up to 100–200 thousand rubles. In case of non-payment, Roskomnadzor may revoke the companies’ data transmission license. Experts talkedthat the equipment is too expensive to install, so providers may opt for fines or simply exit the market.
