On the portal of legal information, a government decree of May 6 was published, which introduces changes to the 2020 decree “On rates and the basis for calculating customs fees for customs operations related to the release of goods.” The new document, in particular, assumes that in the case of the import of electronics into Russia, the importing company “in the event that at least one product from the list is declared in the customs declaration” will be obliged to pay a customs fee of 30 thousand rubles, the amount does not depend on the size of the consignment . The regulation will enter into force 30 days after its publication.

The annex to the document lists a wide range of electronics: base stations, solid state drives, smartphones, printers, sound recording equipment, game consoles, cameras and camcorders, thermostats, clocks, sensors, counters – a total of 108 HS codes. In the project passport on regulation.gov.ru, the Ministry of Finance is listed as a developer, the co-developers are the Ministry of Economy, the Ministry of Industry and Trade, the Federal Customs Service and the Ministry of Digital Development. The Ministry of Digital Development, the Ministry of Economy and the Ministry of Finance did not respond to requests. The Federal Customs Service forwarded the questions to the Ministry of Industry and Trade.

According to Kommersant, such a measure was discussed in the summer of 2022. At that time, it was assumed that the introduction of an additional customs duty on electronics would make it possible to raise up to 10 billion rubles annually, which would then be used to support Russian manufacturers and component developers.

“All funds from customs duties will be directed to the development of Russian electronics, scientific research and the creation of our own competitive products,” the Ministry of Industry and Trade told Kommersant.

The current customs legislation assumes that when importing into Russia a consignment of electronics worth more than 10 million rubles. the importing company pays a customs fee of 30 thousand rubles, and up to 10 million rubles – less than 30 thousand rubles, explains the logistics director at the Russian distributor of electronics. The amount of the fee in the case of importing a consignment worth up to 10 million rubles, according to him, depends on the price of the goods: “In fact, 30 thousand rubles is the maximum fee for the import of goods. The new resolution actually equates the minimum collection threshold for goods included in the annex to the resolution, which previously amounted to 775 rubles, to the current maximum of 30 thousand rubles.

He adds that the new rules will not affect the work of large electronics distributors, but “the work of companies importing small quantities will become more difficult”: “The cost of importing test samples of new electronics, which distributors import for certification and testing, may also rise in price. Changes in the rates of customs duties will most strongly affect importers who import small consignments of consumer electronics: for them, the amount of the fee will increase significantly, agrees Mikhail Khaletsky, lawyer and partner at the NSP Law Office.
