In the first half of 2023, foreign investors began to turn to Russian courts in economic disputes 60% more often. They managed to win 93% of cases. This was announced by the Chairman of the Supreme Court of Russia Vyacheslav Lebedev at the International Legal Forum of Asia-Pacific countries.
“The number of economic disputes involving foreign entities in the first half of this year amounted to 10.6 thousand cases – 60% more than in the same period last year, and the number of disputes won by them amounted to 9.9 thousand cases, or 93%.” , said Mr. Lebedev (quote from “Prime”).
According to the Chairman of the Supreme Court, a favorable business climate is facilitated by the effective administration of justice in tax disputes involving foreign investors. In the first six months of this year, Russian courts satisfied 49% of foreign investors’ claims to challenge decisions, actions and inactions of tax authorities.
As Mr. Lebedev noted, in order to maintain high standards of legal protection for international business, Russian judicial practice implements a presumption of the reliability of information. In total, 52% of foreigners’ claims to challenge decisions of customs authorities and 74% of claims for compensation for damage caused by customs authorities were satisfied.
During the annual meeting of judges with the president in February, Vyacheslav Lebedev said that last year 1.7 million economic disputes were considered in arbitration courts, about 14 thousand of which involved foreign investors. Their demands, according to the Chairman of the Supreme Court, were 97% satisfied.
