FAS fined Pochta Bank 400,000 rubles

FAS fined Post Bank JSC 400,000 rubles. for distributing inappropriate advertising, in which important information was indicated in small print. About it reported in the press service of the supervisory agency.

The FAS clarified that the service had previously received a complaint from an individual. In particular, it said that in the advertisement the bank indicated in large print the interest rate on the loan from 4%. At the same time, information about the conditions affecting the cost of the loan, as well as the possibility of participating in the promotion, including the amount, term, etc., was indicated in a footnote “in a font difficult to read for a short time.” In this regard, the FAS came to the conclusion that users received incomplete information.

As a result, the FAS recognized the advertisement as improper under Part 3 of Art. 28 and part 7 of Art. 5 of the Law “On Advertising” and issued an order to the credit institution to stop the violation. In accordance with the law, advertising of credit services must contain all the conditions determining the full cost of the loan.

It is clarified that Pochta Bank reported on the execution of the order, but continued to broadcast advertising with violations. In this regard, a fine of 400,000 rubles was imposed on the company. according to Part 2.4 of Art. 19.5 of the Code of Administrative Offenses of the Russian Federation (failure to comply with the FAS order within the prescribed period). The maximum penalty under this article provides for a fine for legal entities in the amount of up to 500,000 rubles.

In October, Pochta Bank already was getting fine for fine print in advertising. On October 6, the FAS recognized the advertisement as improper, ordered the violations to be corrected, and issued a fine of 500,000 rubles. according to Part 6 of Art. 14.3 Code of Administrative Offenses of the Russian Federation (violation of advertising legislation). The maximum penalty includes a fine of up to 800,000 rubles.
