As a general rule, in case of partial satisfaction of the claim, the defendant has the right to recover from the plaintiff part of his legal expenses. The Supreme Court of the Russian Federation (SC) will figure out whether it is lawful to impose them on the plaintiff if the amount exceeds the damages awarded to the defendant. Lawyers’ opinions differ. Some consider it necessary to reduce the amount of expenses in favor of the violating defendant, otherwise the victory in court loses all meaning. Others see the large amount of legal fees as a tool to counter the greenmail on the part of the plaintiffs, who may make unreasonably high demands.
