Carlsberg did not achieve the lifting of the ban on suing Baltika – Kommersant

The Arbitration Court of the North-Western District rejected the complaint of the Danish company Carlsberg Breweries for a ban on initiating proceedings with the Baltika brewing company in the Maritime and Commercial Court of Denmark. Prior to this, the Arbitration Court declared illegal the revocation of the rights to use the beer brands of its owner from the Baltika brewing company.
“Leave unchanged the determination of the first or appellate instances or the determination of the first and the decision of the appellate instance,” says the court decision (quoted from TASS).
The first instance made its decision on December 15. Details of the case were not disclosed, since the process was closed at the request of Baltika.
In the lawsuit, Baltika demanded that Carlsberg be prohibited from terminating its licensing relationship with it for the use of brands. It also said that the Danish company could begin proceedings in the Maritime and Commercial Court of Denmark in order to deprive the Russian company of part of its rights. The court prohibited Rospatent from registering the termination of the rights to use trademarks for the brands Seth & Riley’s Garage, Holsten, Kronenbourg and Tuborg.
After the outbreak of hostilities in Ukraine, Carlsberg planned to leave the market and sell its Baltika Breweries. On July 16, Vladimir Putin signed a decree according to which the shares of foreign companies in Baltika are transferred to the temporary ownership of the Federal Property Management Agency. After this, Carlsberg terminated the licensing agreement with Baltika for the use of its brands.
