British antitrust regulator completes investigation against Amazon and Meta

UK Competition and Markets Authority (CMA) announced last Friday, November 3, to stop investigations into Amazon and Meta (recognized as an extremist organization in the Russian Federation and banned). Both American companies were checked by the regulator for abuse of their position in the online retail market.

The CMA opened an investigation into Meta in June 2021. The regulator was looking into reports that Mark Zuckerberg’s company was gaining an unfair advantage over competitors who published online advertisements for their products on Meta platforms. In particular, the company was suspected of collecting information about user interactions with advertisements of third-party sellers on Meta sites in order to then offer its own products to these same users. The regulator obtained from the company a refusal to use such data to improve its own services. In addition, UK users of Meta will now be able to disable the transfer of data on interactions with advertisements of third-party sellers to the US corporation.

Investigation into Amazon was started in July 2022. The regulator was checking whether Amazon really gives advantages on its marketplace to its own sellers, that is, its own retail business, as well as those sellers who use its services in storing and delivering goods, in comparison with others. As part of the agreement with Amazon, the US retailer will prevent the US retailer from using its marketplace data it receives from third-party sellers to gain an unfair competitive advantage and will allow sellers to negotiate their own shipping rates directly with independent Prime Delivery providers.

Independent monitors approved by the CMA will monitor compliance with Amazon and Meta’s commitments.
