The Supreme Court of the Russian Federation (SC) SC considered a dispute on the payment of a multi-million percent remuneration to an arbitration manager (AC) and determined the criteria for their accrual. The bankruptcy law does not establish other conditions for receiving AC interest, except for the share of repayment of creditors’ claims. But the Supreme Court decided that the percentage of the remuneration is a bonus that is due to the manager only with the maximum efficiency of his work, and not for the simple performance of duties. The AHs consider the decision unfair and contrary to the law. Lawyers’ opinions differ.
