Tinkoff-Bank lost more than 30 claims in the case of debiting funds after a profitable currency exchange during the outage. In 23 more lawsuits, he won, said RBC representative of the investor group Dmitry Butryakov. He and a representative of Tinkoff Bank noted that most decisions have recently been made in favor of the bank.
Mr. Butryakov said that from April to November 2022, the courts always took the side of the plaintiffs, and later they began to make decisions in favor of the bank. In some cases, Tinkoff has already paid the money, according to an investor representative.
Tinkoff-Bank stated that “part of the decisions were actually made in favor of the plaintiffs” at the very beginning, when the courts “were only trying to sort out the subject of the dispute.” “Now, when the courts have the opportunity to delve deeper into the situation and abuses of customers, the vast majority of decisions are made in favor of the bank,” a bank representative said.
In February and March, during a sharp collapse of the Russian currency, a number of Tinkoff clients found a way to profitably exchange currencies for rubles using intermediate conversion into pounds and euros. In March, they faced write-offs: the bank considered their transactions to be unjust enrichment.
