The Russian court found Linde’s compliance with EU sanctions illegal – Kommersant

The Arbitration Court of St. Petersburg found that the engineering company Linde unlawfully followed EU sanctions against the Russian customer Ruskhimalliance LLC (RHA; partner of Gazprom and Rusgazdobycha on projects in Ust-Luga). The court also decided to recover 114 billion rubles from Linde.
According to decision courts, EU sanctions are contrary to Russian public policy. The defendants were required to “do everything to fulfill their obligations,” including imposing obligations on the Russian legal entities to return advances and pay damages.
Following the imposition of sanctions in 2022, the German company notified RHA that it was suspending operations. Before this, the company received an advance from the customer. RHA filed a lawsuit due to failure to comply with all terms of the contract for the design, procurement and construction of a gas processing plant.
The total value of the contract was €5.9 billion, of which RHA paid €1.024 billion. Legal proceedings began in December 2022: the court seized Linde’s Russian assets. In March 2023, RHA filed a claim to recover funds as debt under the contract.
