Kommersant got acquainted with the data of the Moscow Digital School (part of Ultimate Education) and the EDB law firm, according to which the number of lawsuits regarding the protection of copyright in musical works against federal broadcast TV channels in 2023 increased by 33% year-on-year. The authors received more compensation during the period: if in 2022 the court recovered a little more than 9 million rubles, then in 2023 the total amount was almost 17 million rubles.

It is clarified that the study analyzed lawsuits against terrestrial digital television channels that broadcast in free-to-air format. These are Channel One, Russia 1, Russia K, Russia 24, OTR, TV Center, NTV, REN TV, TV-3, Channel Five, Match TV, Karusel. , “Muz-TV”, STS, TNT, “Friday”, “Domashny”, “Spas”, “Mir” and “Star”.

Judicial practice shows that violations by major television channels are assessed seriously, which is reflected in the amount of compensation, says Spartak Khulkhachiev, leading legal adviser in the intellectual property practice of the EDB Law Firm. Thus, the amount of compensation in a particular case is determined by the circumstances in which copyright infringement occurred, he points out: “In these court decisions it often follows that musical works were used without permission in large television projects.” And such television programs are shown in prime time throughout the country, and the number of viewers is significant, the lawyer notes.
