The Ministry of Internal Affairs supported the relaxation of some norms for labor migrants

The Ministry of Internal Affairs of Russia supported some relaxations of the migration legislation proposed earlier by business ombudsman Boris Titov, writes “Kommersant” with reference to the letter of the deputy head of the department Andrey Khrapov.

In January, Titov, in a letter to Deputy Prime Minister Tatyana Golikova, proposed extending the validity of labor patents from one year to three years, as well as allowing “bona fide employers” to apply for the opening of entry into the Russian Federation for foreign employees who had previously been expelled from the country for minor violations. As an example, he pointed to the ban on entry into the Russian Federation for couriers who violated traffic rules several times.

Khrapov notes the readiness of the Ministry of Internal Affairs to reduce the period for issuing a patent from ten to five days, as well as to increase the period of its validity, but he does not specify by how much.

At the same time, the department does not support the idea of ​​a mechanism for the rehabilitation of expelled employees at the request of employers. They believe that classifying an offense as “small” and employers as “bona fide” is evaluative, and granting such a right to business will lead to the emergence of one-day companies specially created to open entry to violators. The Ministry of Labor believes that such a practice will only provoke an increase in the number of offenses.

At the same time, the FSB and the Ministry of Finance support both proposals, Khrapov noted.

Kirill Kabanov, a member of the Presidential Council for Human Rights, said in a conversation with the publication that in Russia it is necessary not to weaken, but to strengthen migration control. Law enforcement officers, he believes, should pay more attention to “ethnic enclaves.” According to Vladimir Volokh, professor of the Department of Management of Migration Processes at the State University of Management, migrants expelled from the Russian Federation for minor violations should be allowed to return back.

In November 2022, Head of the Main Directorate for Migration of the Ministry of Internal Affairs of Russia Valentina Kazakova informedthat there are now about 6 million foreigners in the country, half of which are labor migrants.

About 750,000 more of this number are foreign citizens temporarily or permanently residing in Russia, and another 400,000 are foreign students. Since the beginning of last year, about 660,000 cases of fictitious registration of foreigners were recorded, they were deregistered, and criminal cases were initiated on the facts of offenses. The number of fictitious marriage registrations was 220, the representative of the Ministry of Internal Affairs added.
