In Russia, there is a tendency to impose taxes on large legal entities from other companies that do not depend on them, for example, they work on a franchise, said Galina Akchurina, partner at Kept (former KPMG). According to her, the tax authorities may come with checks to companies that attract persons working under special tax regimes in different regions, especially monobrands.
“It concerns a lot of people: both those who sell clothes and shoes, and those who provide cellular communication services and services in other sectors. As soon as there is work with mono-brand or close to mono-brand points of sale in other subjects of the federation, and these persons may find themselves in special regimes or apply some tax advantages due to their independence or being in a certain territory that provides certain benefits, respectively, begins verification,” the lawyer said on session “Kommersant” “Law in the era of sovereignty: how can lawyers help business, owners and the state?”, which was held as part of the St. Petersburg International Legal Forum.
According to Ms. Akchurina, if companies during the audit reveal such signs as labor migration, fairly strong integration of IT systems, the availability of information that legal entities provide each other “in excess” of what independent companies can give, this may be a reason for tax purposes. In this regard, she recalled the Zenden case.
