The government withdrew the draft law on “take or pay” contracts for railway transportation

The Government of the Russian Federation withdrew the draft law on the regulatory framework for the introduction of “carry or pay” agreements (ship-or-pay, or take-or-pay) on the railway. This is reported in card project in the electronic Duma database.
“Carry or pay” is a contract scheme that establishes the obligations of the carrier (in this case Russian Railways) to take out a certain amount of the client’s cargo. The client undertakes to provide goods for transportation.
The bill was registered in December 2021. The explanatory note to it noted that the introduction of the necessary regulatory framework for concluding “carry or pay” contracts would make it possible to guarantee the loading of promising transportation capacities, as well as ensure the transportation of goods under long-term contracts.
The idea of creating a “carry or pay” mechanism on the railway was discussed for several years. How wrote in the fall of 2021, Vedomosti, during discussions, excluded from the bill the clause on granting priority access to infrastructure for those who enter into Russian Railways take-or-pay contracts.
It was assumed that from 2022 to 2024 only those who send Kuzbass coal to the east in export directions will be able to conclude such contracts. The non-penalty limit for deviations from contractual volumes in the project was proposed to be set at 5% for both the consignor and the carrier.
How wrote formerly Vedomosti, loading on the network Russian Railways for 4 months of 2023, it showed a symbolic increase of 0.2% compared to the same period last year and amounted to 411 million tons. This is the first time since the beginning of the year when the volume of cargo flows on a cumulative basis since the beginning of the year turned out to be higher than last year’s level.
