The Dzerzhinsky District Court of Volgograd dismissed a lawsuit filed by lawyer Stanislav Anokhin against the Moscow Central Department Store demanding that he return the things he bought for 846 times cheaper than their actual cost. The store’s counterclaim against the buyer to invalidate the transaction was also dismissed by the court. About it informs TASS.
In July 2021, Mr. Anokhin bought 19 branded items through the TSUM app, which, due to a failure on the site, cost from 19 to 129 rubles. Order for the amount of 2.7 thousand rubles. went through the payment, but the store refused to send it and returned the money. The man went to court demanding the return of paid purchases, citing consumer protection law.
Representatives of the Central Department Store said that there was a technical failure on the website of the trading house and the prices began to be displayed incorrectly. The store promised to send the order subject to an additional payment up to the actual cost of the goods.
Courts of three instances sided with the store, after which Mr. Anokhin appealed to the Supreme Court of Russia. There are previous solutions canceled and sent the case for review to the district court of Volgograd.
