The court refused “Yandex” to seize the accounts and property of A&DD Company

The Moscow Arbitration Court left unsatisfied the application of Yandex on taking measures to secure a claim against the distributor of digital devices and accessories A&DD Company, should from court records.
“Yandex» requested interim measures in the form of seizure in the amount of 891.5 million rubles. on the funds of the legal entity of the distributor A&D Company LLC, and also asked to prohibit the Rosreestr department in Moscow from performing registration actions in relation to the company’s real estate, and the traffic police department of the Main Directorate of the Ministry of Internal Affairs of Russia for Moscow from performing registration actions in relation to transport.
Judge of the Moscow Arbitration Court, Irina Vasilyeva, refused to satisfy Yandex’s application, because “the applicant did not prove the validity of the application of the claimed measures, did not provide evidence that the failure to take the requested measures may make it difficult or impossible to enforce the judicial act in the case, as well as the possibility of causing significant material damage to the applicant.
“Yandex” addressed to the Moscow Arbitration Court with a claim by A&DD Company on November 23. The case file states that the company is asking the court to recover from the distributor a debt in the amount of 761.6 million rubles. and a penalty in the amount of 0.1% for each day of delay until the day of actual fulfillment of the obligation under the supply agreement dated July 25, 2019.
According to Yandex itself in a comment to TASS, the company filed a lawsuit due to A&DD Company’s failure to fulfill its obligations to pay the debt under the contract for the supply of smart devices.
A&DD Company (Accessories & Digital Distribution Company) was founded in 2008 and operates in the field of official distribution of accessories and digital devices on the Russian market. The company cooperates with more than 60 brands, including Toshiba, JBL, Energizer, Belkin, BIC, etc.
