The court refused to allow Rosprirodnadzor to recover 263 million rubles from ChMK – Kommersant

PJSC Chelyabinsk Metallurgical Plant (ChMK; part of the Mechel group) avoided recovery of almost 263 million rubles. for polluting the Miass River. The Arbitration Court of the Chelyabinsk Region made a decision on the claim of the Ural Interregional Directorate of Rosprirodnadzor, partially satisfying the claims. The defendant was charged only the amount of state duty to the federal budget, reports press service of the court.
The supervisory authority sent a statement to ChMK in May. The Ural Department of Rosprirodnadzor asked the court to recover damages from the enterprise – almost 263 million rubles – caused to the Miass River as a result of the discharge of wastewater in excess of the maximum permissible concentrations of pollutants. ChMK drained wastewater from the Balandinsky, Kashtaksky and Pershinsky outlets from June 2013 to February 2016, as well as from May 12 to 19, 2016.
The operative part of the court’s decision was announced on November 7. The court declared the actions of ChMK to discharge hazardous waste into the Miass River illegal. “The rest of the claims will be rejected,” reports the press service of the regional arbitration court.
As reported by Kommersant-South Ural, in July 2022, the Metallurgical District Court of Chelyabinsk sentenced three ChMK employees to suspended sentences in the case of pollution of the Miass River with industrial wastewater. The head of the department of labor protection, industrial safety and environmental activities, his deputy and the chief engineer were found guilty under Part 2 of Art. 247 of the Criminal Code of the Russian Federation (violation of the rules for the circulation of chemicals, resulting in environmental pollution). In July of this year, the Chelyabinsk Regional Court overturned the verdict and dismissed the criminal case in connection with the imposition of a court fine on the defendants.
