The court recognized the state’s right to a “golden share” in the Novosibirsk enterprise of the Kalashnikov concern

The Arbitration Court of the Novosibirsk Region recognized for the state, represented by the Federal Property Management Agency, the special right of a “golden share” in relation to the JSC Institute of Applied Physics (IPF, Novosibirsk), which is part of the Kalashnikov concern.
The Federal Property Management Agency filed a lawsuit against the enterprise privatized 28 years ago a year ago. In the lawsuit, representatives of the department pointed out that the IPF “illegally denies and does not recognize” the right belonging to the Russian Federation, which prevents the state from participating in the management of the institute.
The court agreed with the agency’s position. According to the materials of the arbitration, the right of a “golden share” in relation to the IPF was introduced by the order of the State Property Committee on February 1, 1994 for a period of three years. However, later the federal law “On privatization” was adopted, according to which the right of the “golden share” assigned to the state could be terminated only by decision of the government of the Russian Federation.
The Institute of Applied Physics was founded in 1966 in the Novosibirsk Academgorodok, in 1994 it was privatized. Since January 2020, a 41% stake in IPF JSC has been owned by the Kalashnikov group of companies. According to the official website, the IPF is a developer of S-8 and S-13 unguided aircraft missiles with various types of warheads, fired jammers to counter high-precision weapons. The missiles produced are installed on Navy ships, armored vehicles, Strategic Missile Forces complexes, and aviation.
