The court on the suit of the Prosecutor General’s Office arrested three plants of the German billionaire Merkle

Arbitration Court of St. Petersburg and the Leningrad Region for lawsuit The Prosecutor General’s Office imposed provisional measures in the form of arrest on Russian companies, including three cement plants associated with the HeidelbergCement group of German billionaire Ludwig Merkle.
Ludwig Merkle is a German billionaire owner of the Merckle Group, which he inherited from his father, industrialist Adolf Merkle. Merkle, with a net worth of $7.1 billion, ranks 162nd on the list of the richest billionaires in the world and 13th on the Forbes list of the richest businessmen in Germany.
The lawsuit was accepted for proceedings on August 8. The first meeting is scheduled for August 25th. According to “Interfax”, the arrest was imposed on 100% of the shares of HeidelbergCement Rus LLC, JSC Slantsevsky Cement Plant Tsesla, JSC Raw Materials Company, JSC Gurovo-Beton. The court also banned changes to the registers of shareholders of companies.
The court granted the petition in order to exclude “difficulty in the execution of a judicial act” and “prevention of causing significant damage.”
The Prosecutor General’s Office demands to claim 100% of the shares of HeidelbergCement Rus, 277.369 thousand ordinary shares of Raw Materials Company JSC, 55.539 thousand shares of Tsesla Shale Cement Plant JSC in favor of the Russian Federation, as well as 100% of the shares of Gurovo-Beton OJSC » in favor of the Tula region.
The defendants in the case are HeidelbergCement Central Europe East Holding and HeidelbergCement Rus. Four shares of the Tsesla plant are claimed from Sergei Bondarev, and another share of the plant is from Lyudmila, Evgeny, Oksana Porozov, who own it in equal shares.
The Prosecutor General’s Office petition for interim measures states that HeidelbergCement Central Europe East Holding is registered in another country and “may take actions aimed at withdrawing the property complex of controlled enterprises, their sale to third parties, which will lead to a stop in technological cycles, a reduction in production capacities, the creation of artificial shortage of manufactured products on the market.
The German HeidelbergCement AG is one of the world’s largest cement producers. The Russian “daughter” of the company is registered in the Moscow region. Its revenue in 2022 amounted to 17.2 billion rubles. In Russia, it owns the Tsesna cement plant in the Leningrad Region, the Gurovo-Beton limestone and gypsum processing company in the Tula Region, and the Raw Materials Company, which specializes in the extraction of decorative stone, limestone, gypsum, chalk and slate in Bashkiria.
On August 5, RTVI published an article in which toldthat over the past few weeks, the Prosecutor General’s Office has filed four such lawsuits against various enterprises in Russia. One of them, in particular, was filed with the owners of the Rostov Optical and Mechanical Plant. Another lawsuit was filed against Fininvest, which controls Russia’s only boric acid producer, the Dalnegorsk Mining and Processing Plant. The judicial acts state that the requirement to transfer them to the state is connected with “the facts of the loss of economic sovereignty by Russia” and the transfer of property under the control of foreign individuals or legal entities.
