The court fined “Yandex” for failure to provide user data

This data is necessary for the FSB to search for people and ensure the security of the country. The court ruling has already entered into force. The maximum fine under Part 4 of Art. 13.31 of the Code of Administrative Offenses of the Russian Federation (repeated failure by the company to ensure the implementation of the requirements for its equipment and programs for conducting a search by state agencies or organizing state security) is 6 million rubles.
For the first time, the company was fined for failure to provide data in 2022. Then the Meshchansky Court of Moscow fined Yandex 400,000 rubles. According to the company’s defender, Yandex was not able to comply with the legal requirements, according to which it is necessary to purchase, install and configure foreign-made hardware and software, which is currently impossible, the lawyer explained.
In 2022, some Yandex services were included to the register of information dissemination organizers (ORI) on the Internet. In accordance with the law, these companies must store information about users, including correspondence, for one year, and also provide this information at the request of the FSB and other law enforcement agencies in the course of their operational-search activities.
