The court allowed Natura Siberica not to pay 3.8 billion rubles of damage from the fire

The Tenth Arbitration Court of Appeal upheld the decision of the first instance, which refused to satisfy the requirements of the Dmitrov Experimental Plant of Aluminum and Combined Tape (DOZAKL) and the insurance company “Ingosstrakh» on the recovery of 3.8 billion rubles from the structure of Natura Siberica (LLC First Solution).
In May 2020, DOZAKL filed a lawsuit against First Solution LLC in the amount of RUB 4.5 billion. In this amount, the plaintiff estimated the damages from the fire that occurred in the premises rented by the defendant. The fire destroyed the entire main production building, equipment and inventory. Two employees of Natura Siberica, who carried out welding work, were blamed for the fire. Later, the amount of claims was reduced, and the lawsuit itself was joined by “Ingosstrakh“.
In the first round of proceedings, the cosmetic company lost the courts in both the first and second instances. But the appeal came to the conclusion that the culprit of the fire had not been established, and the fact that welding work had become the cause of the incident had not been proven, so he sent the case for a new trial. This turned the course of the process in favor of Natura Siberica.
The suit of DOZAKL and Ingosstrakh, which could have led to the bankruptcy of Natura Siberica, was the last obstacle to the acquisition of the company by the holding AFK Sistema, market participants said earlier. At the end of 2022, a corporate conflict ended in the cosmetics group, as a result of which the work of stores was disrupted and production was stopped. And in January 2023, the hereditary conflict also ended: three children of the founder of the cosmetics company Andrei Trubnikov received shares in the structures of Natura Siberica after the court recognized the businessman’s third marriage with Anastasia Trubnikova as invalid. The heirs almost immediately ceded their shares to the AG Corporation group of companies, which, according to lawyers, is an intermediary in the deal with AFK Sistema.
