Rospotrebnadzor allowed a lawsuit to be filed against Aeroflot due to the cancellation of cheap tickets

Rospotrebnadzor is considering the possibility of filing a class action lawsuit against Aeroflot airline due to canceled tickets for the Ekaterinburg-Phuket flight. The condition for filing a claim in court will be the required number of statements from victims, reported press service of the department.

Last week Aeroflot customers complainedthat the company has canceled reservations for cheap tickets to Phuket purchased on October 19. According to them, the airline explained the appearance of such cheap tickets on its website by a technical glitch.

Rospotrebnadzor indicated that canceling tickets issued at an erroneous price is illegal. “The airline’s offer on the website about the cost and basic conditions of transportation is a public offer. After payment by the passenger, the airline does not have the right to unilaterally refuse to provide services,” the message says. The Supreme Court of Russia adheres to a similar position, Rospotrebnadzor noted.

According to the report, Rospotrebnadzor also instructed territorial authorities to advise passengers in detail and assist them in preparing claims and statements of claim. “Rospotrebnadzor is considering the possibility of filing a class action lawsuit if the required number of applications from victims is collected,” the department concluded.

A similar situation occurred in 2021 with the Moscow TSUM. Through the TSUM app, a resident of Volgograd bought 19 branded items, which, due to a glitch on the website, cost from 19 to 129 rubles. Order for the amount of 2.7 thousand rubles. The payment went through, but the store refused to send it and returned the money. Representatives of TSUM stated that there was a technical glitch on the website and prices began to be reflected incorrectly. The man went to court.

The courts of three instances sided with the store, after which the buyer appealed to the Supreme Court of Russia. There, the previous decisions were canceled and the case was sent for review to the Volgograd district court.
