RBC: Claims for 3 billion rubles were filed against STLC due to payments on Eurobonds

The management company (UK) Pervaya filed a lawsuit against the State Transport Leasing Company (STLC) with the Moscow Arbitration Court. The Criminal Code demands to recover 3.15 billion rubles from STLC. due to payments on Eurobonds, the holders of which are the clients of the UK. As Oleg Goransky, director of legal affairs at Pervaya Management Company, explained in a conversation with RBC, the reason for filing a lawsuit was STLC’s evasion from issuing replacement bonds in Russia to replace those that were blocked due to sanctions. STLC refused to comment on RBC’s lawsuit.

The lawsuit was registered on December 30, 2022. Initially, the preliminary meeting was scheduled for March 31 this year, but it was postponed to April 28.

Last spring, due to sanctions, Russian companies faced difficulties with payments on Eurobonds. At the same time, companies are obliged to fulfill their obligations under Eurobonds to Russian investors. To do this, they must issue replacement bonds in Russian jurisdiction or make payments in rubles to special accounts.

Earlier, due to non-payments on Eurobonds, lawsuits against STLC were filed by bondholders who are in the management company Rosgosstrakh Life and NS Bank. The management companies demand to recover 6.4 million rubles each. and 18 million rubles. respectively. Another class action lawsuit is being prepared by a group of private investors. According to RBC, from April 2022 to March 2023 STLC must pay about $180 million to Eurobond holders.
