The Dom.RF state corporation is trying to establish the right of the federal authorities to an architectural monument – the Perovsky house on Novaya Basmannaya in the center of Moscow. The procedure could be required due to the illegal reconstruction of the building where the Ogni Moskvy bank was located. The object can be adapted for an office or a hotel, but the number of investors will be limited by the security status of the building and the need to invest more than 400 million rubles in the project.

Dom.RF filed a lawsuit against the Department of City Property of Moscow (DGI) to recognize the federal authorities’ ownership of the reconstructed building at 27 Novaya Basmannaya Street, building 1. This follows from the case files. The meeting at the Moscow Arbitration Court is scheduled for May 24.

The building on Novaya Basmannaya is the Perovsky House, an object of cultural heritage of federal significance, built in 1819 on a pre-existing foundation. In Soviet times, there were residential apartments and a grocery store here. The building went down in the history of modern Russia as the central office of the Ogni Moskvy bank, whose license was revoked by the Central Bank in May 2014. The co-owner and president of the bank was Maria Roslyak, daughter of the former first deputy mayor of Moscow, Yuri Roslyak, who oversaw the economic bloc. Maria Roslyak was declared bankrupt in 2017.

Dom.RF explained to Kommersant that the state corporation acts as an agent of the Russian Federation in relation to the object, which was transferred in the changed space-planning characteristics. The lawsuit was initiated to recognize the ownership of the building, taking into account its actual condition. The DGI clarified that the rights of the city were not violated, and the proceedings were directed to the court to eliminate the discrepancy between the information in the USRN and technical inventory documents. After the object is planned to be sold at auction, they added to Dom.RF.

Based on the court practice involving JSC Dom.RF, Forward Legal’s lawyer Yevgeny Zubkov believes that an unauthorized reconstruction was probably carried out in relation to the facility on Novaya Basmannaya. This, he said, could lead to a discrepancy between the actual area of ​​​​the object and the parameters indicated in official documents. Discrepancies threaten a potential buyer with difficulties in registering property rights, so they must be eliminated before bidding, the lawyer explains. According to Mr. Zubkov, the discrepancies can be eliminated only through the court, which will appoint an examination to evaluate the reconstruction. If the court legalizes it, there will be no obstacles to the sale, he points out.

Arkhnadzor coordinator Rustam Rakhmatullin speaks of the high cultural and artistic value of the Perovsky house, noting that the estate is associated with the names of many famous figures. According to him, this is a rare example of a wooden building for Moscow, the territory of which has been preserved in historical dimensions. Representatives of “Arhnadzor” do not know about the reconstruction in this facility. Dom.RF added that it is planned to secure an obligation for the future owner to carry out work to preserve the monument. Natalya Kruglova, adviser to the general director of the Auction House of the Russian Federation, says that the protected status of the object will not allow increasing the area of ​​the building and implies additional costs for reconstruction – about 60 thousand rubles. per 1 sq. m. “The liquidity of the object is average, it will not be easy to sell it,” the expert warns.

Director of the Department of Capital Markets and Investments of IBC Real Estate Nikolai Goryunov believes that the building may be of interest to the buyer at a price of 230-270 million rubles. Anna Sorokina, senior director of the Commonwealth Partnership, believes the building could be used to house a representative office, club space for the business community, or a boutique hotel. But, she notes, investors are now acting extremely cautiously and it is possible to sell the object only if the buyer has all the information about the building.
