Neural networks will have lawyers. Microsoft promises to protect users’ rights to content generated by the company’s virtual assistant in the courts. We are talking about the Copilot application, which appeared in the 11th version of Windows. The IT corporation explains its decision by the fact that its clients are afraid of lawsuits, and therefore are cautious with the new service. Does artificial intelligence have copyright? And how to protect yourself from neural networks? Aelita Kurmukova found out.
The Copilot virtual assistant will appear in a preview build of Windows 11 in the summer of 2023. And for now it is available to Insider members. In addition to standard settings in the form of modes and lights, the online assistant helps create documents, emails and even presentations. And it produces content based on the works of authors and artists.
In essence, this is a compilation, and claims from copyright holders are not excluded. Microsoft decided to take on all possible controversial issues in the courts, including payment of compensation in case of unfavorable decisions. This means that the lawyers of international giants are confident that they will win this battle, notes Valentin Kaskov, IT Director of the Special Systems and Technologies Group of Companies:
“When we make a compilation from different parts of songs or paintings, copyrights are not violated in this case, because a new object of art and culture will be created. And he will have some kind of authorship. If a neural network as an intangible asset belongs to one or another company, then this organization may well claim that it is the author.”
This is precisely what Microsoft is guided by when promoting its virtual assistant to the masses. Although, at the legislative level, the same American courts declare that artificial intelligence cannot have authorship. Hollywood screenwriters, artists, writers who are afraid of being left without work are suing the developers. But customers sometimes have more rights than the authors themselves, adds Ekaterina Kozyreva, general director of the Soyka communications agency:
“If we, for example, bought a picture from an artist, then he paid us and transferred the rights to us. Next, this image essentially belongs to the agency. We can do whatever we want with it. We can modify and publish it or ask the neural network to generate some similar materials based on it. For example, I had Cheburashka in the picture, and I want the neural network to add Gena the crocodile. My Cheburashka is taken as a base, redrawn by a neural network in some other style that I specified, and Gena the crocodile is added. It turns out that only the reference remains from the original Cheburashka.”
The reference—an auxiliary image—is also used by the artists or designers themselves when creating their drawings. But the neural network does this faster and cheaper, say Kommersant FM’s interlocutors, who resort to the help of artificial intelligence. And to prevent such services from stealing drawings, for example, from the copyright holder’s website, it is better to protect them ourselves, says Natalya Tsarevskaya-Dyakina, director of the Edtech Hub of the Skolkovo Foundation:
“The primary attribute of any creativity is still a person. Remember the NFT hype? This is one of the ways to protect any image on the Internet. When a unique NFT code is attached to a creative product, that is, a token that acts as a guarantee of ownership of this image by a specific person. Even if we don’t go the NFT route, then protection from downloading is a decrease in image quality, watermarks that are displayed after downloading, automatic links, signatures.”
But if photographs and drawings can be hidden from artificial intelligence, then what about voices? This issue is still outside the legal field. In Russia as a whole there is no law that regulates the use of neurons. And lawyers in such disputes are still guided solely by a moral code.
