Moderna to Sue Pfizer and BioNTech for Patent Infringement

Moderna will file a lawsuit against Pfizer and BioNTech due to the illegal use of its patents in the development of coronavirus drugs, informs press service of a biotechnology company.
“We believe that Pfizer and BioNTech have illegally copied Moderna’s inventions and continue to use them without permission,” said Shannon Time Klinger, Chief Legal Officer of Moderna.
Moderna is convinced that Comirnaty’s vaccine, developed by Pfizer and BioNTech, infringes on the company’s patents filed from 2010 to 2016 covering the underlying mRNA technology. The company also noted that this technology was critical in the development of the Moderna Spikevax vaccine, but Pfizer and BioNTech copied this technology without permission to create Comirnaty.
The lawsuits will be filed in the District Court of Massachusetts, as well as in the regional German court in the city of Düsseldorf. The company does not intend to seek a withdrawal from the market or an injunction against its release due to its importance in the fight against COVID-19. In addition, Moderna will also not claim monetary losses from Comirnaty’s sales in the 92 low- and middle-income countries that are included in the GAVI COVAX Advance Market Commitment program.
“We are filing these lawsuits to protect the innovative mRNA technology platform we pioneered by investing billions of dollars and spending a decade patenting it prior to the COVID-19 pandemic,” Moderna CEO Stephane Bancel said in a statement.
