Until the end of 2023, the Ministry of Digital Development intends to achieve the approval of amendments to Federal Law 223 (governs the purchases of state-owned companies), which will allow large government customers to purchase Russian software without competitive procedures, the head of the Ministry of Digital Development Maksut Shadayev told reporters on September 6. “By the end of the year, we hope we will approve changes to 223 FZ. We hope that several companies will be able to approve their roadmaps,” Mr. Shadayev said.
We are talking about the development of a “market in exchange for investment” mechanism, which the Ministry of Digital Development has been discussing with IT companies since the end of last year. The scheme assumes that the IT company assumes obligations to the government in terms of development time and investment volumes in products that can potentially replace the software of foreign suppliers, taking into account the requirements of large Russian customers. These obligations are specified in separate roadmaps, which are jointly prepared by software vendors and customers, and verified by the Ministry of Digital Development. If the card is approved, the developer receives the status of a systemically important company, and the state customer receives the opportunity to purchase the product without conducting competitive procedures.
Prime Minister Mikhail Mishustin instructed the government to develop a similar mechanism in June 2023 following the results of the CIPR forum. The measure, in essence, was required in order, on the one hand, to speed up the procedure for replacing foreign solutions with Russian ones on the infrastructure of state customers, and on the other hand, to provide domestic software developers with a guaranteed demand for their products.
