Marketplaces will pay the treasury – Kommersant FM

Wildberries supported the idea of ​​giving marketplaces the function of tax agents. This will allow sites to pay the treasury for their sellers. Now entrepreneurs pay taxes themselves. The head of Wildberries, Tatyana Bakalchuk, in an interview with RBC, said that changing the mechanism is a logical development of the industry. Moreover, the initiative was already discussed in May at the suggestion of the Ministry of Labor. The agency suggested that platforms withhold taxes, but not from all sellers, but only from self-employed people. However, there was no reaction from market players then. Now Bakalchuk claims that back in the spring the Federal Tax Service asked: why not make the sites tax agents?

How can innovation be implemented in practice? “Kommersant FM” discussed this issue with marketplace expert Viktor Subbotin: “Now the platform acts only as a sales aggregator and intermediary, providing logistics services, promoting goods, accepting and transferring payments. We pay tax after receiving funds from the marketplace.

The question is how this will be resolved from a tax point of view. Will transfers from the site also be marked that the tax on them has already been paid? What will the scheme be? It seems to me that you will have to prove that the tax was paid by Wildberries and transfer documents electronically via the PDO system to the tax authorities. But this would be interesting for sellers, because there are a lot of small individual entrepreneurs trading on marketplaces, for whom tax accounting is very difficult.”

If fiscal authorities share their powers with marketplaces, sellers will no longer have to calculate the tax base on their own, Kommersant FM’s interlocutors note. In their opinion, this will save sellers from unnecessary paperwork and make trading on platforms more attractive. Therefore, the platforms support the reform.

However, experts note that it is difficult to implement the initiative. It is not clear, for example, how to collect taxes from sellers represented on several marketplaces at once. Difficulties will also arise with those who have outside income, notes Dmitry Kirillov, adviser to the Lidings law firm:

“If they are presented on different platforms, the sale occurs once on one of these marketplaces, accordingly, it takes into account the receipt of money and also withholds tax. But the procedure can be applied only under those taxation regimes when the funds from the sale of a specific product are untied from the general flow of money that the seller receives.

For example, under a simplified taxation system, all income from the seller’s activities is summed up, and the taxes that need to be paid are already calculated. And in such a situation, it will be impossible, of course, to withhold tax on the sale of each specific product.

If the Federal Tax Service sees a technical opportunity, and even more so there is a dialogue with marketplaces, this will benefit everyone. Everything can be solved only by developing or installing additional modules in the marketplace software.”

The Federal Tax Service stated that nothing prevents marketplaces from becoming tax agents now. However, for now, platforms can only pay for the self-employed, and this will require the consent of sellers. In order for the powers of market players to expand, changes in legislation will be required, Kommersant FM interlocutors note.
